Welcome to First Thing Bars, Inc. ("First Thing Bars," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, www.firstthingbars.com (the "Site"), and any products, content, or services offered through it (collectively, the "Services"). By accessing or using the Site, joining our waitlist, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order or enter into a binding agreement with us. By using the Site, you represent that you meet this requirement.

2. Products and Availability

First Thing Bars sells breakfast protein bars and related products. All products are subject to availability. We reserve the right to limit quantities, discontinue a product, or refuse any order at our discretion, including orders that appear fraudulent or placed in violation of these Terms.

Some pages on the Site may be for pre-launch, waitlist, or pre-order purposes only and do not constitute an offer to sell a product until an order is confirmed and payment is processed.

2.1 Food Safety and Allergen Disclaimer

Our products are manufactured in a facility that may also process peanuts, tree nuts, milk, soy, wheat, eggs, and other common allergens. Please review the ingredient and allergen information on each product listing carefully before purchasing or consuming. If you have a food allergy, sensitivity, or medical condition, consult your physician before consuming our products. First Thing Bars is not liable for adverse reactions resulting from consumption of our products where accurate ingredient information was made available prior to purchase.

Our products are not intended to diagnose, treat, cure, or prevent any disease, and statements about our products have not been evaluated by the Food and Drug Administration (FDA).

3. Waitlist

Joining our waitlist does not guarantee product availability, pricing, or priority access, though we will make reasonable efforts to notify waitlist members ahead of general availability. We may use the contact information you provide to send updates about product launches, restocks, and promotions, consistent with our Privacy Policy. You may unsubscribe at any time.

4. Orders and Payment

By placing an order, you represent that the payment information you provide is accurate and that you are authorized to use the payment method. All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing or typographical errors, and to cancel any order affected by such an error, even after an order has been confirmed.

Orders are not final until payment is successfully processed and you receive a confirmation email.

5. Shipping

We ship within the United States only. Shipping timelines are estimates and not guaranteed. We are not responsible for delays caused by carriers, weather, or other events outside our control. Risk of loss and title for products pass to you upon our delivery to the carrier, except where our Refund Policy provides otherwise. Full details are set out in our Shipping Policy.

6. Returns, Refunds, and Cancellations

Because First Thing Bars sells consumable food products, all sales are final and we generally do not accept returns for opened or perishable items, except as required by law. If you receive a damaged, defective, or incorrect order, please contact us at hello@firstthingbars.com within 30 days of delivery, and we will work with you on a replacement or refund. 7. Intellectual Property

All content on the Site, including logos, text, graphics, images, and product names, is the property of First Thing Bars or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any Site content without our prior written consent.

8. User Conduct

You agree not to:

Use the Site for any unlawful purpose;
Attempt to gain unauthorized access to the Site or its systems;
Interfere with the proper functioning of the Site; or
Submit false or misleading information when placing an order or joining the waitlist.

9. Third-Party Links and Services

The Site may contain links to third-party websites or services (including payment processors such as Shopify Payments) that are not owned or controlled by First Thing Bars. We are not responsible for the content, policies, or practices of any third-party sites.

10. Disclaimer of Warranties

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FIRST THING BARS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless First Thing Bars, its founders, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your purchase shall be brought exclusively in the state or federal courts located in the State of Delaware, and you consent to the personal jurisdiction and venue of those courts. Nothing in this section prevents either party from bringing an individual claim in a small claims court that has jurisdiction over it.

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
